1. Acceptance of Terms
By creating a ChargeGuard account you agree to these Terms of Service. If you do not agree, do not use the service.
2. Description of Service
ChargeGuard is a fraud and chargeback risk scoring and alert platform for e-commerce merchants. The service analyzes order data and delivers risk signals to help merchants identify potentially fraudulent orders.
3. Disclaimer of Warranties
ChargeGuard provides risk signals and alerts only. We do not guarantee the prevention of fraud, chargebacks, or financial loss. All decisions to hold, cancel, or fulfill orders remain solely with the merchant. The service is provided "as is" without warranties of any kind.
4. Limitation of Liability
ChargeGuard shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the service, including but not limited to lost revenue, chargeback losses, or merchant account terminations.
5. User Responsibilities
Merchants are responsible for maintaining the security of their account credentials, using the service in compliance with applicable laws, and making their own independent decisions regarding order fulfillment.
6. Payment and Billing
Paid plans are billed monthly. Merchants may cancel at any time. No refunds are issued for partial billing periods.
7. Termination
ChargeGuard reserves the right to suspend or terminate accounts that violate these terms or are used for unlawful purposes.
8. Changes to Terms
We may update these terms periodically. Continued use of the service constitutes acceptance of updated terms.
9. Governing Law
These terms are governed by the laws of the State of Ohio.
10. SMS Messaging Consent
By providing your mobile phone number in ChargeGuard account settings and checking the SMS consent checkbox, you are giving express written consent to receive recurring transactional SMS fraud alert messages from ChargeGuard. This consent is specific to ChargeGuard SMS alerts only and is not bundled with any other agreement. Consent is not a condition of purchase or use of the service. Mobile opt-in data and consent will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. Message frequency varies based on order volume. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.
11. Limitation of Liability for Risk Scores
ChargeGuard provides fraud risk scores as informational guidance only. Scores are based on available signals at the time of the order and do not constitute a guarantee against fraud, chargebacks, or disputes. ChargeGuard LLC is not liable for fulfillment decisions made by merchants based on risk score recommendations. Merchants are solely responsible for their fulfillment, refund, and dispute management decisions.
